Terms & Conditions

1. Rental Agreement:

By signing this document you agree to the terms and conditions below set out by Stornoway vehicle hire. 

2. CANCELLATIONS/AMMENDMENTS:

2.1. Once your booking is confirmed online you have then entered a legally binding contract.

2.2. If you cancel your booking greater than 24 Hours before your specified pick up time we will refund the full amount of the booking.

2.3 If you arrive to the hire late or if you end the hire earlier than booked, we cannot offer a refund on the allocated time.

2.4 If you wish to amend the booking to a new date we can change the booking free of charge as long as it is out with 24 hours of the agreed hire dates.

2.5 If you cancel the booking 24 hours or less before the start of the hire, under no circumstances will we refund any of the ammount of the hire.

3. CONDITION OF VEHICLE:

3.1 The owner represents and warrants that to the Owner's knowledge; the Rental Vehicle is in good condition and is safe for the ordinary operation of the vehicle. Renter represents and warrants that Renter is legally entitled to operate a motor vehicle under the laws of this jurisdiction and will not operate it in violation of any laws, or in any negligent or illegal manner.

3.2 Strictly no smoking and no pets are allowed to enter the vehicle. 

3.3 Vehicles must be returned in a reasonably clean condition, with no more than floor mats dirty and free from excessive sand, litter and upholstery stains. Failure to return the vehicle in this condition will incur a service charge to valet the vehicle.

4. RENTAL AGREEMENT

4.1. You agree with us and acknowledge for the purposes of this rental agreement and related insurance cover that:
    a.   The information, which you have supplied us is true, and that all material facts which may reasonably be expected to affect either the insurance or our decision to enter into the rental agreement with you have been disclosed. False, misleading or untrue information may invalidate any insurance affected in relation to this rental agreement by us, and you may be exposed to unlimited liability to third parties.

    B.   You have not relied on any information or promise about the rental or the vehicle made by us or one of our staff or anybody else and save in the case of fraud you shall not be entitled to make a claim of misrepresentation against us.

4.2. You will indemnify us against all claims by or against us resulting from your failure to comply with the rental agreement and the terms of any related insurance policies.

4.3. You must inform us as soon as possible if the driver(s) or any additional driver(s) incurs or has incurred any other endorsements on your/their license or if there is a change in your/their circumstances since booking which may affect the rental cost.

5. FUEL

5.1. You must return the vehicle with the same amount of fuel as collected, failure todo so you will then be charged the price of the fuel and an additional £10 refueling charge.

5.2 If you put the incorrect fuel you will be you will be charged all costs plus days of hire the vehicle is unable to be used

6. PARKING REGULATIONS/FINES

6.1 Any parking tickets or fines that may occur during the period of hire will be charged back to the hirer, an administrate charge of £10 may be added on top of any fines.

7. EXCLUSIONS 

Persons who have been disqualified from driving during the last 36 months and/or who have more than 6 points on their driving license and/or any of the following offence codes:

i)Theft or unauthorized taking UT

ii) Drink or Drugs DR or DG

iii) Dangerous Driving DD

iv) Driving whilst disqualified BA

v) Driving whilst uninsured IN

vi) Accident Offences AC

vii) Careless Driving CD

viii) Licence Offences LC30-50

ix) Miscellaneous MS50-90

x) Mutual Recognition MR

xi) Special Code/Totting Up TT

2. Persons who have had their insurance declined and/or renewal refused and/or insurance or cover cancelled by any motor insurer

3. Persons engaged in any of the following occupations:

i) Professional sportsman or sportswoman

ii) The entertainment or theatrical profession

iii) Racing or gambling

iv) Foreign Armed forces or Foreign Embassy

4. Persons who have been involved in more than one fault incident within the last 3 years

5. Persons with a current criminal conviction which is not spent under the Rehabilitation of Offenders Act 1974

6. Carriage of passengers or goods for hire and reward including ride-hailing &/or food delivery within the GIG economy &/or any carriage of goods or persons for any form of profit or remuneration

7. Driving by any person other than the hirer who has completed a rental agreement or lease agreement for the period of cover concerned, unless off-hire has been agreed and is included in your schedule.

 

8. INSURANCE:

8.1 The Renter hereby agrees that he / she shall be held fully responsible for the first £1000 excess deductible in case of accident, unless waiver has been agreed before the hire starts. The Renter also agrees that only the vehicle is covered under insurance and the driver or passengers are not covered. The Renter also agrees that personal belongings and other items left in the vehicle at any time are not covered. Using wrong fuel & loss or damage of keys is not covered.

9. INSURANCE EXCESS

The Hirer will be responsible for loss of earnings the company may charge in the event of damage caused by the hirer. The hirer will be responsible for the damage repair amount up to the value of the compulsory excess, in respect of each and every incident involving the hired vehicle. You are advised that the following waivers may be invalidated if you fail to take reasonable measures for the safety or security of the vehicle, its parts or accessories, or fail to comply with all the restrictions on the use of the vehicle or otherwise abuse or misuse it. In an event which involves the police, we reserve the right to charge and hold the full basic excess amount, notwithstanding any excess waiver procured, until the full police report is released. Insurance excess is only available to persons from 25 years old and above.

10.COLLISION DAMAGE WAVIER EXEPTIONS

The collision damage agreed prior to the hire does not cover the below

  • Full cost to damage to wheels
  • Loss or damage of Keys
  • Standard excess is charged on any additional accidents during the hire
  • Damage caused on untheorized roads or taking the vehicle off road with anything other than a 4x4
  • Damaged caused by hitting static objects such as gates, walls, car barriers
  • Damaged caused by hitting overhead objects

11. SCOPE OF USE:

The renter must notify Stornoway vehicle hire if he/she intends on using any vehicles for any mainland trips and a written agreement must be in place. While you are renting the vehicle, you will be liable for any offence committed under the Road Traffic Acts and any other relevant loss in respect of the Vehicle and its use during the rental period which results in the imposition of fixed penalties or excess charges. You hereby authorize us to pass through to you any notice or proceedings received by us relating to a period during which the vehicle was rented to you. You hereby agree to respond to and settle any notice or proceedings so received and to indemnify us against any liabilities or expenses incurred.

Renter will not allow any other person to operate the Rented Vehicle unless an additional driver has been added or before or during the hire, if you wish to add an additional driver during the hire please contact: bookings@stornowayvanhire.uk

12: WHAT TO DO IF VEHICLE HAS BEEN IN ACCIDENT OR STOLEN

12.1 If the vehicle has been stolen, please call police immediately and take note of any crime number provided. Take note of names and numbers of any witnesses if relevant

12.2 You must phone the head office immediately for any accidents and provide police of details that they may ask for.

13. RETURN OF VEHICLE:

13.1 The Renter hereby agrees to return the above-described vehicle to the pick up location on date/time agreed prior to the start of hire.
